For the past decade, the UAE’s Organ Transplant Law has made it possible to receive commonly transplanted organs such as kidneys and livers, as well as bone marrow transplants. Prior to the set of regulations being put in place, patients would need to receive transplant surgery outside of the UAE. Since then, hundreds of medical professionals have been trained in organ transplant procedures, and several units within hospitals have been set up for transplant services.

Organ Donation Regulations

The UAE allows transplantation of human organs from both living and deceased donors, in accordance with provisions indicated in a federal decree law.

Conditions for Living Donors

Living donors must be reasonably regarded as legally competent persons. They must express – in writing or verbally – that they wish to donate their organ(s), and then fill in the appropriate paperwork. Medical risks and potential complications must be assessed by a qualified medical committee; it must be determined that there is no major risk to the donor.

Importantly, donations by living donors are currently restricted to relatives within the fourth degree, and to couples who have been married for a minimum of two years. Living donors have the legal right to – at any time – renege on their decision to donate. However, they may not recover a donated organ once it has been removed.

Conditions for Deceased Donors

It is only permissible to transplant the organs of a deceased person if they made it clear before death that they wish to donate their organs upon death. Emirates Identity cards will state a person’s organ donation status. Organ removal may only start after there has been an official medical confirmation of death.

Health Insurance and Transplant Services

Whether or not organ transplants are covered – and to what extent – varies depending on one’s health insurance plan. Comprehensive health plans in the UAE generally cover the full cost of this service, including associated procedures before and after the actual transplant procedure.

However, this is subject to some variance. It is advisable to always check the exact coverage provided by your health plan. For example, a health plan may cover the entirety of the cost of a transplant procedure, but not the cost of additional care needed in the post-op period.
